From Last Chapter:
The judge looked over at Brain and saw the two of them looking at each other eye to eye and then said, "OK I thank you again Sean and you are excused and may have a seat with your family." Sean got up from the witness stand and came to sit with us. As he walked by Colby's mom and Colby they both gave him a hug as did Steve and I. We made room for Colby to sit next to his dad and Colby who immediately took hold of Sean's hand not caring who saw.
Then judge took a few moments to make some notes and then turned to Brain saying, "Brian before I pass my sentence on you is there any thing you would like to say?"
********** Chapter 44 **********
Brian stood before he started, "Yes sir I would like to say a few things." The judge told him to go ahead.
Brian turned and looked Sean straight in the eye before continuing, "Sir, first I would like to publicly tell Sean how sorry I am. I know what I did to him was wrong and horrible and I so wish I could take back all the pain that I caused you and your family Sean."
Still looking at Sean with tears forming in his eyes, Brian went on, "I can not give you a reason why I did what I did. I can't explain why I disliked gay guys except that it is something that I grew up with."
Brian looked over at his mom and dad for a second with tears rolling down his checks before looking back over at Sean saying, "I have learned that it is wrong to dislike people just because of how they live their lives or their sexuality. Both me and my parents are in counseling where we are working on or prejudices as a family."
As Brian spoke I looked over at Sean and Colby who were discretely holding each others hand and noticed they both had tears running down their faces. Brian had to stop for a moment to get control of his emotions before he continued, "Sean I know what I did to you was wrong and I hope that someday you and your family can find it in your harts to forgive me."
Brian then looked back at the judge saying, "Sir I will except any punishment that you deem appropriate and I thank your for the opportunity to publicly apologize to Sean and his family" With that Brian turned to look back at his mom and dad who were seated right behind him before taking his seat.
Then judge said, "Brain I thank you for your statement and it will be taken into consideration. With that said this court will stand in recess while I make my decision." As soon as the judge finished speaking the bailiff asked everyone to rise as the judge left the room.
Once the judge entered his chambers we all looked at each other for a moment. Steve pulled Sean into a huge as I watched Cobly's mom do the same. I think we were all relieved that this whole ordeal was just about over.
I looked over at Brian who had went over to sit with his mom and dad. His mom was rubbing his back as Brian leaned forward holding his head with his hands. You could see the worry on his face and I couldn't help but feel sorry for the young man. After hearing what he had to say I realized that Brian's prejudices were something that was taught to him by his family. I was also glad to hear that he and his family were in counseling and with any luck they will all learn a few things.
As we were waiting I kept seeing Sean look over at Brian, sometimes watching Brian for a few minutes without looking away. I could tell that Sean was thinking about something, and by the way he kept looking over at Brian I know it had something to do with him.
It had been about a half hour since the judge had gone to his chambers to decide Brian's fate and we were all quietly talking in the court room in several little groups. Sean, Colby and Aaron were all taking to each other off by themselves while Connor hung around with Steve, Linda, and I.
As we were all chatting I saw Sean leave his little group and slowly walk over to where Brian was seated with his family. Colby took a step to follow Sean but Aaron grabbed his arm and stopped him from following. What ever they had talked about I think Aaron realized that this was something Sean needed to do on his own. Steve and I both watched Sean as he walked up to Brian and asked Brian if he could speak to him. Brian looked at his parents and then back at Sean before he stood and followed Sean. They walked over to the other side of the court room for some privacy. We couldn't hear what they were saying but we could see that it was a serious conversation.
Once they were away from everyone else in the court room, Sean looked up at Brian who stood quite a bit taller than Sean. Sean had to clear his throat before saying, "I just want to tell you in person that I accept your apology and I'm glad that you and your family are seeking counseling. I just wanted to ask you a question if you don't mind.
Brian had his hands in his pockets and was looking down at his feet as Sean spoke and really didn't look up when he answered, "Sure Sean, I will answer any question you have, but I want to say again how sorry I am that I did what I did."
Sean said, "Brian I have accepted your apology so please don't feel like you need to keep saying your sorry. I did want to ask you if you could tell me if there was something I ever did to you that caused you to dislike me so much?"
Brian just looked back at Sean for a couple of minutes before he answered, "There was one time that you were in the shower at the school after I had finished working out. When I came into the shower I noticed that you looked at me and I don't know why but it made me feel very uncomfortable. As I showered I felt like you were watching my so I took a very short shower and as I left the shower I noticed that you had a hard on which kind of creeped me out. I had never experienced anything like that and with the way I was raised to hate gay people it just freaked me out. I'm not saying that you did anything to me or say anything to me to make be think that you were hitting on my or anything, it's just when I saw you with a hard on in the shower with me it freaked me out."
I think everyone in the court room was watching Brian and Sean as they continued to speak. Sean tried to make a little joke saying, "Yeah some times it just has a mind of it's own."
Brian laughed a little saying, "Yeah I remember I was the same way when I was your age. But Sean please know that you didn't do anything and I know that now. Going to counseling has shown me that some of the things my family taught me are so wrong and I'm working on changing those things."
As Sean and Brian continued to talk I could see that Sean was relaxing a little bit. You could see that his body wasn't so tensed up and he had taken his hands out of his pants pockets. Sean said, "It really makes me happy that you and your family are seeking counseling. I would really like to talk with you some time about that if you would consider that some day."
Brian answered, "I think I that would actually help me deal with some of my issues, so yeah I would like to do that."
The judge was just about to tap on the little window in the door leading from his office to the court room to have the bailiff call the room to order when he saw Brian and Sean talking. The judge stood there for several minutes watching Sean and Brian talk back and forth. As he watched the two boys talk he was rethinking the decision he had just made about Brian's punishment and he wanted to know what the two boys where talking about. He watched for a couple of more minutes before he tapped on the window to get the bailiff to call the court room back to order.
After hearing the bailiff call the court room to order, everyone walked back to their seats but remained standing while the judge entered the court room. Once the judge had taken his seat everyone else took their seats. It seamed like it took the judge several minutes to get his papers in order before he looked up. The judged looked over at our group for a moment before he looked over at Brian before he spoke, "I would like to say a couple of things before I announce my decision. First off I want to say how impressed I am with how everyone involved in this proceedings has handled themselves in such a professional manner and I want to commend you all for that."
The judge looked over at Sean saying, "Sean I can see that you are a very strong young man with a forgiving heart and I'm sure you will grow to be a fine citizen in this community. I'm sure your parents are very proud of you."
Steve looked over at me and we both gave each other a little wink and smile. The judge then turned to Brian.
"Brain, I would also like to commend you on the way you handled yourselves today. It takes a strong young man to stand up and admit he has done wrong. I'm sure that you will over come this set back in your life and become a fine young man."
The judge looked back down at his papers for a couple of minutes making some notations on them. It looked like to me that he was striking out some thing and then writing something down. He looked over at Brian again saying, "Brian will you please stand. Brian I have read through the case file and listened to what Sean has said as well as your statement." There was a long pause before the judge continued, "Brian after listening to everything presented I came back into this court room with a punishment that I feel fit the crime that you have pleaded guilty to." Again the judge paused for a couple of minutes before he continued. I could see that he was rethinking his decision.
Still looking at Brain, as he stood there with his lawyer at his side and his parents seated right behind him, his mother wiping the tears from her eyes, the judge continued, "As I was about to enter this court room to deliver my decision I saw you and Sean talking. I could see that Sean has truly forgiven you and as I watched the two of you converse I saw that the two of you actually laugh a little. After watching the two of you I reconsidered my decision."
With one last pause he continued, "Brian I here by sentence you to two years in jail after which you will serve one thousand hours of community service." Brian's mother started to cry out load. I looked over at Brian and he had tears rolling down his face and as I looked at Sean he also had tears rolling down his face and was shaking his head back and forth quietly saying no over and over.
Then the judge continued, "However after seeing the two of you speaking with one another I am going to suspend the jail sentence for two years with with a few stipulations." Everyone got control of their emotions as we all waited for the judge to finish. "Fist you will continue with your counseling, second you will work with your school principle to form a gay and straight alliance group for your school and third you will have any trouble with the laws of this state what so ever."
The judge took his glasses off and leaned forward in his chair saying, "Brian this means if do not meat those requirements and I hear that you get stopped for J walking I will revoke your suspension and you will serve the entire two year in jail. Do you understand this sir?"
Brian cleared his throat before answering, "Yes Sir I do and I promise you and Sean that I will follow through with each and every stipulation."
The judge sat back still looking at Brian right in the eye saying, "Brian I do not want to see you in my court room again. With that said, this court stands in recess. Brian the court clerk will have some documents for you to sign and after that you are free to leave. Good luck son." The judge then looked over at Sean saying, "Sean I wish you good luck as well and I hope to hear nothing but good things about you." With that the judge stood as the bailiff called for everyone to stand.
Once the judge had left Brian collapsed in his chair sopping in his hands. Both his mom and dad came around the railing to hug and console their son. Sean was the first of our group to move from our seats and walked straight over to Brian and his family. Brian had calmed down a bit and stood up when he noticed Sean standing in front of him.
We all watched as Sean extended his hand out to shake Brian's hand. We couldn't hear what he said but Brian smiled. Sean then shook Brian's father's hand before extending his hand to Brian's mother who instead of shaking Sean's hand, pulled him into a hug.
The rest of us all made our way to where Sean and Brian where. Steve and I introduced ourselves and then everyone else to Brian and his family. On one really knew what to say but I got the feeling they were just as glad as we were that this was now all behind us. Well at least all but Dennis' trial.
