Chapter 23
"Young man I do not tolerate outbursts in my court room now sit down and be quiet." Judge Frost ordered.
"Your honor." Dylan said as he stood. "That young man is Michael Caine, the brother of the deceased."
"I see, and why was he allowed in here during these arguments?"
"Your honor as you are aware, Mr. Caine actually has the right to be in here during the full proceeding."
"Yes I am aware of that. Mr. Caine I am sorry that this has happened to you, and I do not wish to cause further harm to you, but the defence does have the right to gather its own DNA."
"Then they should have done that a long time ago, your honor if you try to exhume my brother's body, I shall file a stop order against it. I won't have him disturbed, nor shall I want the pain of having to inter him again."
"Mr. Caine my order stands. However, I am adjourning this case for three weeks, Mr. Blaskins that should give you enough time to get the results you need. " Judge Frost spoke leaving no more room for arguments.
"Fine, Mr. Masters file an injunction please." Michael snapped, before storming out of the room.
Blaskins and Heilman were smiling when they heard the judge's order, and even smiled more when they heard Michael scream at the Judge. That smile lasted a very short time as they both heard Michael order the injunction. "Now what?" Heilman asked.
"Now we file an application to have the case dismissed on ground that these delays have infringed upon your right to a speedy trial." Blaskins laughed.
"You had no plans to exhume that kid's body did you?"
"Heck no, I just needed the delay to happen."
"Well when will you file for the dismissal?"
"Today, I have most of the paper work ready, I just needed this judge's decision." Blaskins laughed out loud.
With that said Blaskins walked out of the courtroom. Out in the hallway Blaskins saw Michael, walking up to him Blaskins just smiled. "Have a good day Mr. Caine."
When Blaskins had gone Michael called his lawyer and was speaking to him when Dylan walked over. Hanging up, Michael stared at Dylan for a second before speaking. "Mr. Masters, I apologize for my outburst in there, I know that it didn't help, but it is the emotional damage that this causes that she didn't consider, even though she said she did."
"Mr. Caine your apology is accepted, and I can understand your outburst. I am going to file for a stop order on the exhumation of your brother, however I think you should get your lawyer to do the same with two applications the chances are better."
"I spoke with Mr. Talbert already, in fact that was who I was on the phone with when you walked up. He agrees that an injunction is the best thing and he will be filing it in the morning." Michael stated.
"Great, then I should do the same. Did James tell you which judge he is going to ask for?"
"Well I am thinking that since this is a juvenile case, he would either file with judge Montoya, or some other youth judge. He didn't say."
"Okay, I will go be him a call when I get back to my office, maybe we can work something out together."
"I don't want to be pushy, but you better. Right now I feel like suing for emotional damages."
"You have that right, and maybe you should, though you could lose that said then you would be hurting even more. Think about it carefully."
Meeting up with Sam outside the courthouse, the two quietly walked to Sam's car and went back to Michael's place. When Michael walked in the door he was greeted by silence. Looking around he saw that no one was home, but there was a note by the phone saying that Cory and Derrick were over at the Archers' place and would be there for dinner. Smiling to himself Michael went to his room and changed into his board shorts. Grabbing a towel he then went out and spent the next two hours swimming and laying by the pool. At seven the boys came home and seeing Michael out near the pool quickly changed into their swim suits and ran outside yelling as they jumped into the water. Michael let the two swim until eight then sent them off to shower and get their pajamas on, telling them both that he would have a snack ready for when they came down.
Sleep that night for Michael was anything but pleasant as all he could see were the grave diggers pulling up Tommy's little coffin. Twice the next day as Michael was in class he found himself nodding off. Knowing that by the end of the day, he would have a short temper, he called Scott. "Hey bro, can you do me a huge favor?" Michael asked when he heard Scott's voice.
"Depends on what it is?" Scott laughed.
"Nothing to hard I hope, I was wondering if you could take the boys for the night, I don't feel that I am able to handle them today."
"Oh, what happened?"
"I just didn't sleep to well last night, and my temper is a bit short, I don't want to be screaming at them. Not when it isn't their fault."
"No problem, I will call Richie and have him pick them up from school."
"Thanks, I owe you one."
"Forget it, this way you're not hurting them and you know your limits. So relax and try to get some sleep tonight."
"I will, but again thanks you're a great guy."
As Michael was in class, Sam had spent the morning at the Naples police department going through files, looking for any complaints that students had filed about people stealing their lunch money or threatening them. By lunchtime Sam had found nothing that would help him. Having the name of the boys that had threatened Cory and Derrick, Sam ran their names and found that two of them had juvenile records for theft and assault, and they were still on probation. With the boys address Sam drove over to speak with the parents, but found that neither was home.
When it became dinner time Sam stopped at Michael's place and had a steak sandwich, then went back to the boy's parents place, this time getting both parents at home. Spending an hour talking with everyone, Sam drove back to the Caine house and called it a night. When he walked in he found Michael sound asleep on the couch, his school books scattered on the floor and the TV on low. Going into the kitchen Sam made himself a cup of instant coffee before going back and waking Michael. "Go to bed Michael, sleeping on the couch isn't good for you."
"Yeah, okay. When did you get in?" Michael asked groggily.
"Just now, where are the boys?"
"They're over at Scott's for the night. I didn't feel good with having them around and me with no sleep."
"Smart thinking, now off to bed."
The next morning when Michael woke he felt refreshed and better. He knew that he had slept for a good fourteen hours, something he needed. Showering and dressing Michael left and went over to Scott's place. He was about to knock when Richie opened the door. "They're in the kitchen having breakfast. I hope you're feeling better now."
"I am and I have to thank you guys' big time for this."
"Not. We would have done it anyways. Cory said you didn't sleep the night before."
"How would he know?" Michael asked with a grin.
"I don't know, but you could ask him." Richie laughed.
Walking into the kitchen Michael got body slammed by both Cory and Derrick before he even had a chance to say good morning. "Did you sleep last night daddy?" Cory asked as he held tightly to Michael.
"Yes buddy I slept, in fact Sam had to wake me to send me to bed." Michael chuckled.
"Good, so we can come home tonight and be with you?" Derrick asked as he stared at Michael.
"You bet turkey, I actually missed you two this morning."
"Good, cause we missed you to, I like waking up and knowing you is there." Derrick mumbled.
"Are Richie and Peter taking you two to school or do you want me to drop you off as I head to class?"
"I want you to daddy, please."
"Yes I want you too also." Derrick said smiling.
"Okay, finish your breakfast and I will go get the car, how does that sound?"
"Okay, but hurry." Cory squeaked as he sat back down.
School out for the night Michael picked up the boys and they all went out for pizza, then over to the college where Michael had a basketball practice. Cory and Derrick ran around the court while the team changed. Then they sat at watched as Michael and Scott took on another pair, all four were good, but the two that were playing against Michael and Scott couldn't work as a team. When the time was up, Michael sat with the pair as Cory and Derrick came over and sat on his lap. "Guys, this is Cory and Derrick my two little turkeys." Michael said as he introduced the boys.
"Hey guys, nice to meet you." One player said with a smile.
"Guys you two suck, but I know with daddy's help you can be better." Cory said with a grin.
"Thanks, dude that makes me feel good, and I can be honest and say that no one plays as well as Michael or Scott. I want to learn from them."
"I am willing to help?" Michael started.
"You two come on we have a practice here not a girly fest." Walker yelled.
"Screw you Walker, We want to learn to be a team, and not single minded like you."
"Then I guess you're off the team, I won't have losers playing with me."
The rest of the team were listening, some smiling while the others frowned. Leaving Walker standing there alone the team walked over and sat with Michael and Scott. "Guys, I think it is time for a new captain." Scott stated as he stared at Walker standing alone.
"That is up to the coach, besides Walker has been with the team for the past two years." One player said.
"Yeah, and how many games have you won in those two years, think about it, and I bet you will notice that this year you have gotten a lot farther than ever." Scott argued.
"Your right, this year we have the championship in our grasp, something that hasn't happened for a long time, but it is still the coach's call."
"Yes it is and he will have to make it before the game on Friday night." Michael stated knowing that Walker could hear him.
"Well if we want to win, we are going to need the two of you playing in each game, I don't know how you do it, but you are the perfect pair. You always seemed to know where the other is and what you are thinking."
"That comes from playing together for five years, learning to work as a team. Everyone here could do it, if you just stopped thinking of the glory you want. A team reaps the glory, not the person, sure the player gets the spotlight, but it is the team that counts." Michael admonished.
"So how do we work as a team?" A player asked.
"Easy, forget trying to get the spotlight. Like Michael said let the team have that." Scott answered.
"Guys, it is Wednesday, what do you say we all meet up tomorrow after school and practice team work. The other thing you have to do is learn to trust one another and we can work on that also, though we only have two days to do it." Michael stated. "You have to make the choice."
The trip home was quick and silent as Cory and Derrick had their ear plugs in listening to something, Michael who was driving wasn't paying attention to what Scott was doing, but he could hear pen scratches and paper rustling. A quick glance over and Michael thought that Scott was busy doing homework. After dropping Scott and going home, Michael sent the boys to shower as he sat in the kitchen sipping a coke.
Michael didn't see the boys after he heard the shower stop so he went and checked on them, only to find them both in bed sleeping. Making sure that they were covered Michael then went and had his own shower and went to bed. Sam had left a note saying that he would be in late and not to wait up for him, as he had Michael's spare key and would try to be quiet.
Friday Morning after Michael had made sure the boys were off to school and that he had everything he would need for the day he was about to leave when his home phone rang.
"Good morning." Michael answered.
"Hello Michael, James Talbert, You have to be in court this afternoon for your injunction hearing. Don't worry too much, as both Dylan Masters and I will be there with you." James stated.
"Okay, what time, I am going to have to get someone to pick up the boys if I am not done by three."
"I would suggest you get them picked up, I don't know how long this is going to take, and you have to be there for one o'clock."
"Okay, I will make a few phone calls."
"I will be there, just another hectic day."
"A normal day for you then." James laughed.
"I guess. See you this afternoon."
Michael had just hung the phone up when it rang again. "Damn, I am going to be late for class if this keeps up." Michael thought. "Good morning, how may I help you?"
"Michael it is Mr. Bullinger, I have been able to get the name changed for you and it is being put up this morning, you can move in anytime next week." Bullinger said as a way of good morning.
"That is great, how much extra did it cost?"
"Nothing, I explained to the company CO why you wanted it and he just said not to worry that he would cover the extra."
"Great, what about desks, chairs and other office stuff, has anyone come to you about that?"
"Yes and that bill will be mailed to you sometime next week. I am thinking it shouldn't be more than a hundred grand, but who knows. That is your department." Bullinger laughed.
"Okay I will have the accountants look after it as soon as I get it. I already have the office manager, so now I just have to send word out to the rest of the company offices to let them all know that the place is now open."
"Like I said that is your department and headache. I am just a construction guy."
"Thanks and I hope to see you tonight at the game."
"My family and I will be there. Besides I want to see my oldest boy play. I have heard you have been working them hard, even though you're not the captain."
"They wanted to learn to be a team and that takes work."
"True, well I will see you tonight have a great day."
"You too and stay safe."
This time Michael got out the door and away from home. He stopped and picked up Scott and also took the time to ask Mrs. P to pick up the boys after class. He explained to her why and she immediately agreed, she also said that she would feed the two and bring them to the game. Stating that it would save Michael time from having to stop and get the boys and be at the college on time.
The rest of the morning went zipping by and before Michael knew it. The time had come for him to head over to the court house. Using and underground parkade Michael park and then walked the two blocks. He was just entering the building when Blaskins wandered up. "I hope you know that you are going to lose this case. I am more than prepared to win, or even adjourn it for a few days."
"Not going to happen. Today you will see just how angry I can be if you try to delay this anymore." Michael snapped before storming off, leaving Blaskins flustered.
The court clerks and the bailiff were the only people in the court room when Michael walked in and took a seat on the front bench. The bailiff seeing Michael walked over and handed him a juice box. "Son, you are a bit early?" He said.
"Yes I know, I just figured to be here before Mr. Talbert and Masters got here. Maybe have a few minutes to think."
"I see, well I won't disturb you." The bailiff said as he walked back to his seat.
"Thank you for the juice sir." Michael called out.
"Any time young man."
Michael finished his drink and had gotten the box into the recycle bin when Mr. Masters showed up. Michael could see a small smile on his face and wondered just what he was thinking. The two were just about to walk into the courtroom when Michael heard a small voice calling out. "Daddy, I wanna be wif you." A little blonde waif said.
"Zachary, what are you doing here, and where is your mother?" Dylan asked.
"We here to help you, and mommy went to the baffroom." Zachary said with a big smile.
"Well I am glad to have your help, little man. Now this is Mr. Caine, he is a friend and is the one that needs daddy's help."
"Hi sir." Zachary said looking up at Michael.
"Hello Zachary. Nice to meet you." Michael said and shook the little guy's hand.
"Uh-huh. Daddy can I sit wif you please." Zachary asked.
"Only until the Judge comes in then you will have to sit with your mother."
"Okies. Wuv you daddy."
Seeing the little fireball that Zachary was, reminded Michael of how both Tommy and Adam were, and Michael felt a stab to his chest. At the same time Michael had to smile as he watched Zachary take his dad's hand as the two walked down the aisle to the front of the court room. "Michael, are you alright?" Mr. Talbert asked as he walked up.
"Huh, oh yes sir I am okay."
"For a minute there I thought you were a statue."
"Oh, I was just thinking and watching Mr. Masters little one, he reminded me of Adam and Tommy."
"Yes I can see that, Zachary is a little fireball."
"Well I hope he is allowed to grow up into a big fireball. Now shall we get in there and get this over with, I know of two other fireballs that miss the dad and uncle." Michael whispered softly.
"Michael no matter what happens in here today, I promise you that Tommy will not be exhumed."
"Sir, I honestly wish I could believe that, but somehow I find it hard to, every time I think this is going to be over and done with someone throws a wrench into the works and screws it up."
"Well I know the judge won't delay this any longer than she has too."
"All rise." The bailiff interrupted. "The honorable Judge Frost presiding.
"Be seated gentlemen. Now from what I understand we are here for a hearing on an injunction to stop the exhumation of one Thomas "Tommy" Caine. Is that correct?"
"Yes it is your honor." Talbert said as he rose.
"I am the one that ordered the exhumation, so why are you challenging my decision?"
"We feel that it was wrong and that the survivor would be placed in a precarious situation." Talbert stated.
"Very well, I just have one question, why is this in a juvenile court instead of a circuit?" Frost asked.
"Well your honor, the accused is a juvenile and his lawyer Mr. Blaskins has kept it that way thinking that the DA's office doesn't have enough to move it up." Master said as he stood beside Talbert.
"I see, very well then gentlemen proceed."
"Thank you Ma'am." Talbert started. "Ma'am we have filed this injunction on two points the first is that we feel that what Mr. Blaskins is doing is just a delaying tactic, and in delaying the case, he thinks that he can have it tossed out due to the fact that his client did not get a fair and speedy trial as is his client's right. The other point that we filed on is the psychological damage that this exhumation will cause the family."
"Mr. Talbert, I can understand the first point, but could you please clarify your second on for the court." Frost asked.
"Yes Ma'am. When I was called and asked to file this injunction I was taken back. Ma'am I called a few top psychologists throughout the state, some of them were child psychologists, while others were youth. They all agreed that should Mr. Caine be subjected to such an action, the emotional damage would be irreparable, they went on to say that this could cause Mr. Caine to have a breakdown or become so withdrawn that it would affect his life and the way he handles people. Mr. Caine is the owner and president of a large holding company. A company that deals with a lot of clientele. If Mr. Caine was to withdrawn from society as these psychologists say he would should this order be allowed, he would lose not only his company, but his standing in the business community as well."
"I see, Mr. Masters, do you have anything to add to what Mr. Talbert has said?" Frost asked.
"Yes Ma'am I do. Your honor you totally ignored the FBI report that was handed to you, you also ignored the fact that you were informed that this could cause traumatic results in Mr. Caine. I further agree with Mr. Talbert here that this is nothing but a delaying tactic, and the court should consider that and grant this injunction and allow the trial to resume in a timely manner." Dylan stated.
"Mr. Blaskins do you have an argument to back up your application for the exhumation?" Frost asked.
"Ma'am, I feel that the FBI report is wrong, I asked for this to happen do that I could have and independent company do up another report to either substantiate or denounce the FBI's findings. I do not believe that I am causing a delaying tactic as both Mr. Master and Mr. Talbert are suggesting. "Blaskins lied. "Ma'am if my client is going to have any chance at a fair hearing, then I ask that you allow the exhumation of the boy and not worry too much about the psychological aspect of the order." Blaskins stated.
"Mr. Blaskins are you telling this court that you don't care if this causes Mr. Caine harm."
"Yes ma'am I am. I honestly don't think that it will, I feel that both of these gentlemen are making this out to be about Mr. Caine and not about the trial."
Looking over to where Michael was sitting with Zachary and Mrs. Masters, Judge Frost could see the anger and hurt in Michael eyes. What surprised the judge the most was that Zachary was sitting on Michael's lap and smiling. "Gentlemen I am going to recess this case for thirty minutes while I think this over. During that time I would very carefully think over what you all have asked, and if there is anything more to add I will hear it before I announce my decision." Frost stated heatedly.
Storming off the bench, Judge Frost walked out of the courtroom. In her chambers she sat behind her desk and calmed down some, before grabbing his phone. With two rings of the phone Judge Frost heard the pleasant sound of a woman's voice. "Dr Canalhan's office how may I help you?" The woman asked.
"Good afternoon, this is Judge Frost, is it possible to speak with the doctor for a moment?" Frost asked.
"One moment please."
A minute later a strong, but gentle voice filled Frost's ear. "Good afternoon Judge, what can I do for you?" Canalhan asked.
"Doctor I was wondering if you could tell me the effects that an exhumation would have on a person?" Frost asked.
"Well Ma'am it depends on the age of the person, and what the circumstances were. In most cases, if the exhumation was for the better, meaning if it was to help in an investigation, I am sure that the survivor would understand, now saying that, I can honestly say it will be depressing, and could lead the survivor or survivors into long term depression, which would then have to be treated with medications and therapy.
"Could this depression belong lasting?"
"It could be, depends on how soon the person got into therapy. My opinion would be that if the exhumation isn't really warranted then I wouldn't do it." Canalhan stated.
"I agree and thank you for your time doctor."
Having spoken with the doctor, judge Frost sat at her desk for a few more minutes as she tried to think about what she was going to do. She had left the DNA test results sitting on her bench, so she couldn't look at them until she sat back down.
Going back into the court room Judge Frost looked at all those gathered before she looked at her notes and the papers regarding the DNA. "Gentlemen, do either of you have anything more to add before I make my decision?" Frost asked.
"No your honor" the three men replied together.
"Good. Now we are all human, and sometimes we make mistakes. Sometimes those mistakes can be devastating because we don't take the time to look at the whole picture. I don't want to make a mistake here that is going to cause severe problems. So saying that I have come to the conclusion that the exhumation of Thomas " Tommy" Caine shall not proceed, and that the FBI report is sufficient enough for trial? Mr. Blaskins the trial will resume on Monday at ten am."
"Yes your honor." Blaskins mumbled.
"Mr. Caine I owe you an apology and I do hope that you can accept it. Frost stated.
"I can accept it, and I thank you." Michael said as he rose.
"Great, then case dismissed."
When Michael stepped outside the court house the sun was shining, walking back to his car Michael saw that he still he could still make his classes and be on time for practice. As he drove towards the college he was also thinking about Walker, there was something bothering the guy and Michael was sure that it wasn't something to do with the team. Putting those thoughts aside Michael made it to his business management class just before it started.
Michael really didn't need the course, but the certificate would help others see that he knew what he was doing. He had just sat when his phone vibrated. Ignoring his phone he sat and did his work. Three times his phone vibrated, on the third call Michael answered it only to find out that is was Cory's principal calling. "Mr. Caine, I am sorry for disturbing you, but can you come down to the school. There seems to be a problem with Derrick and Cory." The principal stated.
"I'll be there is thirty minutes, in the meantime I shall have a couple gentlemen there."
"Well that is the problem, the two men you have watching your boys just arrested three students."
"Have the police been notified?" Michael asked as he left the college grounds.
"No I didn't think that should be done. The three boys are not trouble makers."
"I see so you're saying that the men have made a mistake?"
"Yes I am."
"Okay, I will have an officer join me." Michael snapped the closed his phone. Michael parked just outside the main entrance to Cory's school before calling Sam. "Hey Mr. Johnson have you left for the airport yet?" Michael asked hopefully.
"No, I am actually staying a few more days. What can I do for you?"
"Well I am at Cory's school, now seems there is a problem."
"Oh, I can't see your boys causing trouble, so what happened?" Sam asked.
"I don't know yet, other than Carl and Alex arresting three other boys and the principal refusing to call the police."
"Okay I'll meet you at the boy's school and we can both deal with this. If it is the boys I think it is, then they will be having a new home for a while."
"Do you want me to wait for you or head in and talk with Cory and Derrick?"
"No wait for me, that way they won't have to repeat themselves."
"How soon will you be here?"
"I am pulling in now, so meet me at the front door."
"Sure I am on my way."
The school office was crowded when Sam and Michael walked in. The secretary was busy on the phone, while Cory and Derrick sat close to the principal's office. Carl and Alex was standing watching three boys that sat in the middle. The three boys were quietly talking about what they were going to do when they were let go. Seeing the secretary hang up her phone Sam smiled before speaking. "Ms. could you please let the principal know that Mr. Caine and Johnson are here to see him?" Sam asked.
"He is in a meeting right now, please take a seat and wait."
"Ma'am, I don't care if he is meeting with the President, get him out here right now." Sam snapped.
"Just who do you think you are, you can't come in here demanding thing?"
"Actually ma'am I can do just that now get off your lazy butt and do it."
"Well you don't have to be rude."
Two minutes later the principal raced out of his office, his face red with anger. When he saw Michael standing there he stopped short. "Mr. Caine just who..."
"Sir it was not Mr. Caine that ordered you out here it was me." Sam stated, interrupting the principal's tirade.
"And just who the hell are you?"
The three boys hearing the principal yelling at a complete stranger started to laugh. "I am agent Sam Johnson of the SCU. That is special children's unit. Now let's take this into your office."
"Right this way agent Johnson."
"Come on Michael, Cory, you and Derrick also, I am not going to waste a lot of time."
When everyone was in the office and seated, Michael turned to his boys. "Cory, Derrick, please tell Sam and I what happened."
"Daddy, those are the one we told you and Uncle Sam about. Today they again tried to take our money, they even pushed Derrick here, so I started to push them back, no one gonna hurt my brother. When we tried to tell Ms. Thompson she didn't believe us even the principal didn't."
"So why are those three in handcuffs?"
"Cause I told Mr. Morgan and they done it." Derrick said.
"Well Cory, Derrick you both don't have to worry, those boys are getting a new home, I have spent a few days going over some police reports and talking to other students and they have all said the same thing. As for you sir, I am of a mind to charge you with accessory, but I won't. What I am going to do though is talk with the school board and have you fired." Sam stated.
Going out front Sam stood in front of the three boys. "Have your parents been called?" Sam asked.
"What's it to you?" One boy snarled.
"Well kid, I hope they have, because you three are on your way to the juvenile detention center, and you will be there for a while. As of right know you three are charged with aggravated assault, attempted robbery and assault causing bodily harm." Sam stated.
"You can't do that we're only 12." Another boy pipes up.
"Is that true, you're all 12?"
"Yeah, so bite me."
"Charles, what have we told you about using that kind of language?" A woman's voice hollered.
"Mom, he said I was going to juvy." Charles answered.
"Well maybe you should go, it might teach you somethings."
"Mom, you can't mean that."
"I do, now sir why are you here?"
"Cause that dweeb was pushing me around, he was being a bully." Charles lied.
"Oh really, well then I hope that he gets expelled."
"Ma'am I am Sam Johnson, special agent in charge of SCU. I can tell you that if anyone is getting expelled it will be your son and his friends. I have spoken with these young boys and numerous others, all have said the same thing and that is your son and his friends have bullied, assaulted and threatened the students here at this school. Now the fact that your boy is 12 along with his friends, means that they cannot be charged, however if they continue along the road they are on, I will personally see that they spend at least six months in juvenile hall."
"I see. So you are calling my son a liar?"
"No ma'am he isn't but I am." Cory spoke up.
"Listen brat, I wasn't talking to you."
"Ma'am if you call my son a brat or any other name I will charge you with abuse." Michael snapped.
Just as things were starting to get loud the principal stepped out of his office. "Alright everyone settle down. Mrs. Anderson, I have no choice but to expel your son for the rest of the school year, I can give you his school transcript and you may try to enrol him in another school. That is up to you."
"I will sue you all for this. Come on Charles."
"What about my friends?" Charles asked.
"They have to wait for their parents, but like you Charles they are no longer going to this school." The principal stated.
"Charles, Mrs. Anderson wait. Cory called out while looking at the principal "Sir, don't expel him or the others, sure they deserve it, but they also need to be in school, why not just suspend them all for two weeks and then they can have detentions for a month after." Cory stated as he looked over at Charles.
"Well, why would I do that, they have a record of bullying, and Mr. Johnson here has also stated other facts." The principal answered.
"I know that, but maybe this will show them that punishments can be given. Also would show them that next time they do this they will be kicked out."
"Cory, are you saying that they should be given a final chance to change?" Michael asked.
"Yes daddy, I know you would do the same if you could." Cory answered.
"Well Charles it is up to you now, are you going to take this chance and behave or do I continue with the punishment." The principal asked.
"I'll take the punishment, there is no way that I am going to let this dweeb tell me what to do."
"Fine, then Ms. Thompson do you have his transcripts."
"Yes sir I do." She answered handing a file to Mrs. Anderson.
"Charley are you nuts" Cory is that chance open to us also?" One of the other boys asked.
"Sure."
"Then I will take it, I am sorry for you Charley, I thought you would be better than your brother."
"Go to hell Dickson, you're a wuss just like Caine here."
"What about you Walters are you going with Charles or taking the chance you have been given?" Sam asked.
"I am not like Charley or my older brother either, so yes sir I am taking the chance I've been given."
"Okay, then since this is Friday, your suspensions start as of this coming Monday. You both will then be in detention for a month after you return." The principal stated. "If either of you get into any more trouble, you will be expelled no questions asked. Is that understood?"
"Yes sir." Both boys replied.
The basketball game was to start at 7 that night so when Michael and the boys left the boy's school then stopped at a McDonalds for dinner. Michael had called Mrs. P and told her that he had the boys and what had gone on at the school. When he mentioned Mrs. Anderson and her outburst Mrs. P just laughed. "Michael we'll talk when you get to the college, but from what you say, it sounds like her young son is following his brother."
"Could be, but I am not going to worry about it right now, I have a game to win." Michael said with a chuckle.
By the time Michael and the boys got to the gym the place was packed. The seats behind Michael's bench were open for his boys. Sam, Carl and Alex were there with smiles as the two little one ran over, both gave Sam a hug before sitting down. "Hi Uncle Sam, Mr. Carl and Alex." The two said with smiles.
"Hi yourself boys." Carl said with a grin.
"Michael gonna win tonight you watch." Derrick said as he crossed his fingers. With the jump off the game started with Walker getting the ball and heading down court, most frequently of his team mates were open, but Walker just ignored them as he went for a layup, only to miss. When the first period ended the visiting team were a head by eight points. The coach had been watching and now he had to choose what he was going to do. Just before the Second period he called the team together. "Walker, you sitting out this period. Calman you're in. Let's try and get those points back." Coach stated.
"What the hell coach?" Walker yelled. "Why are you benching me?"
"I think it is obvious, but if you want me to spell it out for you then I will."
"I think you want to us to lose. That would is what I think?"
"No, I meant us to win, but that won't happen the way you are playing. I have made my call."
"Fine, then I know we'll lose."
The second period started and Walker could see that the point spread was getting smaller. When the whistle blew at the end of the period the team had gained a ten point lead, now Walker was worried, the team seemed to do better without him. When the game ended Michael's team had won with a thirty two point lead.
When everyone got home it was a small snack for the boys and then right to bed. Saturday morning Michael took the boys to IHOP for breakfast before heading over to the college for the second game. Derrick and Cory took one of the basketballs and were trying to play while Michael and Scott sat in the change room. Alex was on the gym floor watching the two little guys, so Michael could relax a bit before game time. Scott was saying something to Calman when Walker came over. Before Michael even had a chance to stand, Walker gave him a right cross on the chin, bouncing Michael's head off the locker. "Your game is over Caine." Walker snarled.
"No Walker, my game has just started. As for you well you're finished, I don't think the team wants you around anymore."
"He's right Walker, take your things and leave." Calman said as he and the rest of the team stood around him. "We have tried to get you to be a team player, we gave you lots of chances, but hitting Michael is the last. Now get out of here."
Watching closely everyone saw Walker leave the locker room. What they didn't see was Walker talking to the other team captain. When the second game started Michael and his team played exceptionally, by the end on the second period they were up by thirty eight points and it looked like a wash out. Michael meat out the first ten minutes of the third period and was surprised to see the team working well together. Glancing around Michael saw Walker sitting in the stands his face a picture of ours anger. Just before the final whistle blew Michael had just tossed a three pointer and was walking back to his bench when the visiting team captain walked up. "Michael, I got to tell you that I am proud to play against you. I also have to tell you that Walker came up to me before the game and asked me to get the team to take you and Parker out. I told him I would, but that was just to make him happy. I don't play his way and you guys beat us fairly so congrats. On and watch your back, I think Walker is out to get you." The captain said.
"Thanks, and I will. Your team is tough and it makes it fun to play. You be careful too, knowing Walker he might come after you also."
"See you at game three thus afternoon."
"You bet, and I hope you win this one. I would hate to just make it a three game playoff." Michael said with a laugh.
A fourth game was not going to happen as Michael and his team swept the finals without a loss. As everyone waited for the trophy to be given out. Michael saw Peter and Richie walk into the center of the court, both were carrying microphones. When the gym had become quiet and everyone was watching the two, Richie started to speak. "Ladies and gentlemen, friends. It is an honor for my friend Peter and me to stand here and say a few words. So saying that I will let Peter take over."
"I am not much of a speaker." Peter started. "However when we were asked to speak at the end of the finals here, neither Richie nor I could refuse. You are all probably wondering what makes this night so special other than winning the college championship, well let me introduce you to the two people that wanted to make this special. Ladies and gentlemen let me bring out Derrick Alston and Cory Caine, two very special Friends."
Michael watched as his two boys walked out to join Peter and Richie. Derrick had his hands full so it was Cory that took Richie's microphone. "Hi, please forgive me if I fumble my words, but I will try not to. I asked our Uncles to help me write what I wanted to say so blame them for any mistakes." Cory said with a giggle. "Every boy and girl wants to have a hero, doesn't matter who they is. Sometimes the hero is just someone we don't think about, someone who does things for others without thinking anything about what they will get out of it.
A week ago my dad, took Derrick and I out of class for the day because we were having problems. It was while at school that my dad was given the final work that his brother wrote. When my dad read it later he cried, when my Uncle Scott read it he too cried. Why because it showed how much a little brother could admire his older brother.
Both Derrick and I had a chance to read this paper and we too cried and it was then that we talked with our Uncles hoping that they would help us.
Adam, my dad's little brother died almost three years ago, but he wrote about his hero. I know Michael misses his brother, I know that he misses his adopted brother Tommy also, we both that is Derrick and I know that we can never replace either of them, but we can fill the emptiness that fills my dad's heart. We love our dad and tonight with the help of a lot of friends we wish to give to Michael, our dad this plaque with Adam's last work on it, and the truth that he is our hero as well." Cory couldn't continue as he tried to hold back his tears. At that point Richie took the microphone from Cory and giving him a hug just smiled and held him close.
"Ladies and gentlemen a round of applause for our young friend here. Now would Michael Caine please come out and join us." Richie asked.
Michael sat stunned on the bench as he listened to Cory's little speech. When he heard Richie call his name again. Stumbling to the center court Michael gave his two boys a hug. "I am proud of you two." Michael whispered.
"Michael," Peter began. "I am happy and proud to have you as a friend, though there were days when you tested us greatly. Today we honor you for all that you have done over the last eighteen months. We honor the courage you have, but more importantly we honor you for the strength you have used to overcome not one, but four travesties, something I think we all would have given up on. So please accept this plague and the honor and love that goes with it."
"I don't know what to say, you all have stood by me when I was nothing but a pain to you all. I never once wanted glory except for my teams. So I guess all I can really say is thank you all, and to my sons and friends I love you all." Michael said in a rush.
After all the awards had been given out, it was party time. Michael and Scott had taken Derrick and Cory out for pizza and then headed home. Scott hard just parked Michael's car and gotten out when Peter and Richie ran up. "Where have you guys been, mom was starting to worry." Richie asked.
"We went for pizza, mom knew we were doing that. What is wrong Richie?"
"You haven't listened to the news?" Peter asked.
"No, why?"
"Well our place was fire bombed, but so was the amphitheater. Michael they ruined the stage and burnt Tommy's picture."
"Who did, and why?" Michael asked.
"No one knows, I would like to say it was Walker, but I can't. He was in the bleachers when this happened."
"Anderson? I know that the brothers hate us, but that would mean going after Cory and I." Michael stated.
"If it was them, they could still come after you." Richie said with a grimace.
"You're, but I am not going to worry about that right now. I have to little ones to get to bed." Michael stated.
With Derrick and Cory curled up in Michael's bed, the four older boys grabbed Pepsi from the fridge and walked out into the back yard. The four hours sat at one of the small tables talking. The three boys wanted to know what was happening with the trial, but all Michael could say, was that he didn't know. The only thing he could tell his friends that the judge had reversed her decision on exhuming Tommy's body. Peter and Richie soon called it a night and headed back home, leaving Scott and Michael sitting on the patio. At midnight Scott and Michael went to bed. Michael snuggling between his two boys and wrapping his arm around the soon fell asleep.
For the next two weeks everything settled down, Cory and Derrick no longer had problems at school and Michael had finished his finals for the year, so he was able to be home a bit more. Bullinger had gotten Michael's new offices furnished for him at a lot less of a cost than Michael could have. Maria joined Michael the morning he first opened the doors and soon she was running the office like a well-oiled machine, though there were days when Michael would show up and things would seem to come to a stop.
Then it happened. Cory and Derrick were over at Scott's place and Michael was in the Aphex office when the police called and told him that his house had been fire bombed, just like the amphitheater. Now Michael was getting pissed off. "You people better find out who the hell is doing this. This is the second fire of something that belongs to me, so start looking at who wants to hurt me or my family." Michael told the officer standing there.
"Mr. Caine, we will do our job, but we need your help also. First off can you tell us who would want to harm you?" One officer asked.
"I could list a lot, buy since this is happening here in Naples, I can only think of maybe two families. Both of the older boys and I have had problems in the past."
"Will you've able to give us their names?"
"Walker and Anderson, both have gone out of their way to harm us, if it isn't them, then I will have to look at some people I fired."
"I would like it if you could do up a list of those people. I will check out these two boys first."
Now sitting at his desk, Michael had to think about finding a new home while the police and insurance did their things with his old house. For now they could either stay at one of Michael's hotels or if Mrs. P would let them they could stay at her place. Michael didn't want to have problems there which could happen if someone was out to hurt his family.
Grabbing his cell phone, Michael went and found Maria. Letting her know what had happened and that he was gone for the day. "Michael, if you and the boys need a place, Jorge and I will be more than happy to put you all up." Maria said.
"I appreciate that Maria, but until the police find out who is doing this, and they catch them, I don't want to risk anyone else. As it is I am thinking of having to two boys stay with either the Parkers or the Archer family."
"I can understand that and I know that you would never risk anyone, but the offer is there for you."
"Thank you Maria, that means a lot to me, I am glad to have you working for me. You're an angel."
"Go on get out of here before you make this old woman cry."
"Can't have that now." Michael said with a laugh as he left Maria's office and headed to the elevator.
The drive to Mrs. P's place was quick as they hour was over. Getting there Michael saw Cory and Derrick riding up and down the street. Scott and Richie were there watching them so when they saw Michael pull up they were a bit surprised. With hugs out of the way, Michael called his two over and then all of the boys sat on the front lawn. "Daddy, why you here so early?" Cory asked, not that I mind, I like being with you.
"I know you do, and I like being with you both also, but I came to tell you that our home was burnt down."
"WHAT, WHEN?" Scott screamed.
"This morning, I would guess just after we all left."
"Who is doing this to you?"
"It could be anyone, or it could be someone we know or I have fired."
"So where are you going to stay?" Richie asked.
"Well that is another reason I am here, I want to ask your mom if the boys can stay here, that way I know they are safe." Michael stated.
"You know you don't have to ask, but what about clothes?"
"We'll go shopping this afternoon. We won't pick up a lot. Maybe just enough to last them a week."
"You know mom is going to totally pissed over this?"
"Yes I know, but this is not something I did."
"True, where will you be staying, you said the boys, why not you also?" Scott asked.
"I don't want to risk it, I will stay at the hotel until I can find a new house or rebuild. I know I can get Mr. Bullinger to rebuild for me and he would do it safely and quickly, but that is only after the insurance company says okay."
"Will the company pay for your room and meals?"
"I don't know, and honestly I am not worried about that, I just want my boys safe."
"Well they will be safe here, I can even get Peter and his brothers to help watch also."
"I don't want anyone hurt."
"Anyone tries to hurt these two turkeys, they will feel a neighborhood on their ass." Richie laughed.
"Well just be careful please?"
As Michael and his boys were getting ready to go shopping, two Naples police pulled up in front of the Walker home. Walking up the first officer rang the doorbell
With the help of Scott and Mrs. P, Michael got new clothes for the two boys and himself, then as a treat, Michael took everyone out for a Rib dinner. As the four were sitting quietly talking Michael started to laugh. "Michael Caine, what's gotten into you?" Mrs. P asked.
"Oh nothing really, I was just thinking how Richie and Scott are going to be upset that they weren't with us." Michael answered through his laughter.
"Oh my, you are evil aren't you?"
"Uncle Michael, can't we take them a doggy bag?" Derrick asked with a wide grin.
"Woof, woof." Cory chuckled.
"You three." Mrs. P laughed.
"I guess we can get them a puppy bag." Michael snickered.
Having dropped the boys off with Richie and Scott. Michael was just about to get back into his car when he was stopped. "Caine, I need to talk with you." Walker yelled from across the street.
"What do you want Walker?"
"Just to talk, that is all."
"Fine, come over here."
Standing in front of Michael, Walker stared at him for a moment. "Caine it is no secret that I don't like you and that I have made your life hell on the team. To me you are a glory hound plain and simple. The reason I am here though isn't to tell you that. I had the cops show up at my place today asking me about the fire at the amphitheater and your house. I didn't do either. I want you to know that." Walker said.
"Look Walker, I told the police that you and I were having problems, I won't deny that. The fact that they talked to you is good, maybe it will clear you maybe it won't. The thing is you're a good player, you just have to quit thinking of yourself when you're on the floor. The other thing is if you didn't start the fires then who did? I am just glad no one was home when it happened."
"I don't know who started the fires, and yes I too am glad no one was hurt."
"You know Walker when you aren't on the court you probably are an okay guy. I mean you didn't have to come talk to me, but I am glad you did. Now if you want we can get together more and talk, maybe work things out and we could be friends."
"Why, after everything I have said and done to you over the past year, you are willing to forget all that and try to be friends."
"Actually it was a nine year old that taught me that, he is the one that showed me that some people deserve a second chance."
"Smart kid."
"Yeah he is."
"I better get going, and thanks for talking to me, I didn't think you would." Walker said as he turned and started walking away.
"Walker, why don't you meet me for lunch tomorrow?"
"Are you sure?"
"Yes, I am, meet me at the Aphex offices say at eleven thirty?"
"Okay, I can do that."
After Walker had left, Michael drove over to his old house and took a look around, hoping that something could be salvaged, but seeing the place Michael knew that nothing was left, whoever did it had done a good job. Leaving the area Michael remembered the bracelets he had bought the boys and had to smile. "Good thing I left them in the car." Michael thought as he pulled into the hotel parkade. Grabbing the bracelets, Michael locked up his car and headed to the foyer. Walking up to the front desk he smiled at the clerk and waited for her to finish her call. "Yes sir what may I do for you?" She asked as she hung up the phone.
"I was wondering if the Caine suite is in use." Michael asked.
"Let me check. No sir it is free for now, but it looks like it is booked for all of next week." She answered.
"I see, What about the Presidential suite is that open?"
"Yes sir it is, do you wish to book it?"
"Yes and for a long period of time. You can send the bell hop up to make sure that there are towels and snacks available. I will be in the dining hall."
"Yes sir, I just need your credit card."
"No you don't, just make sure that Aphex holdings knows where to reach me if they need to."
"Sir, I can't book the room without your card."
"Yes you can, since this hotel fall under Aphex and I own Aphex holdings." Michael said with a smile.
"Oh, well let me get the manager."
"Please do, but like I said I will be in the dining room, I am getting hungry."
Two hours later Michael was sitting in his suite, his laptop open and was going over some of the company reports. He was reading the financial pages out of California and noticed a large amount of money was being used for something he wasn't aware of. Grabbing his phone he called Maria at her home. "Yes Michael, what can I do for you?" Maria asked when she heard his voice.
"Maria, do you know what is going on out in California, there seems to be a lot of money going out and nothing showing as to where it is going?"
"I wasn't aware of that, I will get onto it first thing in the morning."
"Thank you Maria, oh and please check out the spending in Seattle also. I don't like what I am seeing."
"I will do that and have a report on your desk by noon."
"Again thanks, now go take care of your little guy." Michael said with a laugh.
Having finished his reading, Michael went and took a look at houses and places he could buy so that he didn't have to stay in a hotel forever, besides he wanted his boys with him. Thinking of Cory and Derrick, Michael called the Parker home and wished them both a good night, telling him that he would see them for dinner the next day.
Earlier that day Curtis Anderson and his old coach were both smiling as they watched the police drive away. They both had been questioned in connection with the firebombing of the Amphitheater and the Caine home. "I am glad they didn't asked about the boat I stole last summer." Curtis said with a chuckle.
"Yes we were lucky, but now we have to be very careful, we can't do anything until things cool down some." The coach stated.
"I know, but I want Caine to pay for what he cost me." Curtis said in anger.
"He cost you a lot, but he cost me my job and license, I can't get a teaching job anywhere in this damn state."
"I know, but I think I have a way to make him fork over some money, but right now like you said we have to cool things."
"Tell me what you plan."
"Oh nothing much and I can't do anything until school starts again, so that gives me time to really plan things out, until then I want to keep it to myself."
"Okay, now you better head home, we don't want your mother hollering at you."
"Like she would, she has Charley to worry about right now. My bro got himself expelled because of Caine's kids."
"Charley is following in your footsteps is he?"
"Yes, and doing a great job." Curtis laughed.
Curtis had just gotten home and out of his car when two police cars pulled up. "Curtis Anderson?" One officer called out.
"Yes."
"You are under arrest for the firebombing of the Tommy Caine amphitheater and for the arson of the Caine home.
You have the right to remain silent. If you give up that right anything you say can and will be used against you in a court of law. You have the right to speak to an attorney. If you cannot afford an attorney, one will be appointed for you. If you choose to answer questions without an attorney, you can stop at any time and an attorney will be appointed for you. Knowing and understanding your rights as I have explained them to you are you willing to answer my questions without an attorney present?" The officer asked as he finished cuffing and reading Curtis his rights."
"Yeah I understand." Curtis snarled.
"Are you willing to answer our questions?"
"Not likely."
"Very well, please watch your head as you get into the car." The second officer stated.
As Curtis was being booked into the county jail, his brother Charley who had seen everything sat on the couch in his living room. The TV. Was turned off and Charley leaned back. At five his mother walked in the front door with a scowl on her face. "Charley, I have about had it with you boys, I am really starting to think about sending you either to your father, or off to some military school. I don't know what has gotten into you or your brother, but it is driving me up the wall." Mrs. Anderson stated as she hung up her coat.
"Mom, Curtis was arrested today."
"I know, he called me at work."
"Oh, well is he getting out?" Charley asked.
"I don't know Charley that is up to the judge in the morning."
"Okay up can we have hamburgers for dinner, I got most of it ready?"
"Sure, let me change and then I will start them."
"Thanks mom, oh something else, but we can talk after I hope."
"Sure now go wash up."
